1. A – There are no costs associated with the CCFRC and or any of its partners in this process.
2. A – You will hear a message about upcoming weekly workshops that you may attend at no charge. Also you will be given the opportunity to choose a location in Clayton County, for your convenience, to meet with a HUD approved counselor, also at no charge to you.
3. A – To help expedite your first contact with the HUD approved counselor, you will need the follow:
Copy of your most current mortgage statement
Last year tax returns
Last two months of ALL bank statements
The two most recent pay stubs from each employer of the borrower on the mortgage (even if only a part time job and/or if you only work one day a month – All Paystubs)
Any documentation from the court or sheriff regarding your foreclosure
Any correspondents from your mortgage company or its attorney
Most recent bills and statements (Light, gas, water)
4. A – 3-4 Months
5. A – No! No counselor or agency working with you (even if they are a HUD approved counselor or an attorney) can guarantee you that you will not be foreclosed on if you meet all the conditions of foreclosure. It is imperative that you work closely with your counselor and retain everything in writing.
6. A – First file a written formal complaint through the organization assisting you. Wait to see the response within a timely manner, and then if you need to proceed, you may want to contact the local Housing and Urban Development Office at www.HUD.gov
7. A – Yes! www.HUD.gov
8. A – If you rent your home, a new law (S.896) in effect as of May 20, 2009, may protect you. If a new owner who took over your home in a foreclosure after May 20, 2009, wants to terminate your tenancy, he or she may not do so if you have a lease which has not expired and at the very minimum must give you a 90-days notice of termination of tenancy. If the new owner gives you a notice of anything less than 90 days to terminate your tenancy, without stating a reason or for the reason that your home has been foreclosed upon, you should send the landlord a letter telling the landlord that s/he must give you a 90-days notice of termination of tenancy.
9. A – You have all of the rights listed above regarding your lease and the requirement that the owner give you a 90-day notice to leave.

The foreclosure is not a lawful reason to terminate your lease.
